Notice is given that the Commission of the City of San Antonio, Florida will consider approval of Ordinance No. 01-2024, approving a designated truck route during a public hearing to be held during the regular commission meeting scheduled:

AN ORDINANCE OF THE CITY OF SAN ANTONIO, FLORIDA, AMENDING THE CITY CODE, ARTICLE II, BY ADDING DIVISION IV, SECTION 50-80 PROVIDING FINDINGS OF THE COMMISSION; PROVIDING FOR DESIGNATED TRUCKS ROUTES AND REMOVAL OF UNDESIGNATED STREETS AS STREETS USABLE BY TRUCKS EXCEPT UNDER NARROW CIRCUMSTANCES AND EXCEPTIONS; PROVIDING FOR PROPER SIGNAGE FOR NON-DESIGNATED ROADS; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEAL OF CONFLICTING CODES, ORDINANCES, AND RESOLUTIONS PROVIDING FOR SEVERABILITY AND SCRIVERNER’S ERRORS; ; PROVIDING AN EFFECTIVE DATE.


 

Interested persons can appear and be heard on this Ordinance at the Commission Meeting by attending the meeting and signing the request form. Copies of background materials, the complete proposed ordinance may be reviewed or obtained at the office of the City Clerk, 32819 Pennsylvania Avenue, San Antonio, FL, 33576 M-F, 8:00 AM to 4:30 PM.

 

Any person who might wish to appeal any decision made by the City of San Antonio Commission in public hearing or meeting is hereby advised that he/she will need a record of the proceedings, and for such purpose, he/she many need to ensure that a verbatim record of the proceedings is made which will include the testimony and evidence upon which such appeal is to be based (Florida Statute 286.105).  Verbatim transcripts are not furnished by the City.

The City is of the view that the following exception(s) to the Business Impact Estimate requirement apply that are checked off in a box below apply to the above-referenced proposed ordinance, although the City is implementing the procedure required by statutory law to ensure that no inadvertent procedural issue could impact the enactment of the proposed ordinance.

The proposed ordinance is required for compliance with Federal or State law or regulation;

The proposed ordinance relates to the issuance or refinancing of debt;

The proposed ordinance relates to the adoption of budgets or budget amendments, including revenue sources necessary to fund the budget;

The proposed ordinance is required to implement a contract or an agreement, including, but not limited to, any Federal, State, local, or private grant, or other financial assistance accepted by the

The proposed ordinance is an emergency ordinance;

The ordinance relates to procurement; or

The proposed ordinance is enacted to implement the following:

a. Part II of Chapter 163, Florida Statutes, relating to growth policy, county and municipal planning, and land development regulation, including zoning, development orders, development agreements and development permits;

b. Sections 190.005 and 190.046, Florida Statutes, regarding community development districts;

c. Section 553.73, Florida Statutes, relating to the Florida Building Code; or

d. Section 633.202, Florida Statutes, relating to the Florida Fire Prevention Code.

 

In accordance with the provisions of controlling law, even notwithstanding the fact that, an exemption noted above may apply, the City hereby publishes the following information:

 

1. Summary of the proposed ordinance (must include statement of the public purpose, such as serving the public health, safety, morals, and welfare):

 

Ordinance designates specific roads within the incorporated boundaries of the City of San Antonio for use by regulated trucks in excess of one-ton capacity or containing 3 or more axles. Approved roads include all roads under FDOT jurisdiction, designated truck routes set by Pasco County BOCC, and Pennsylvania Avenue east of Curley Street.

 

Ordinance does not prohibit operation of trucks on streets of destination, emergency vehicles, government vehicles, and detoured trucks on routes established by the county, state, or city.

 

Ordinance complies with section 316.555 Florida Statutes, intending to provide for public safety and convenience of users of roads within the City of San Antonio. Reduction in traffic density and intensity of infrastructure strain from traveling public is intended by adoption.

 

2. Estimate of direct economic impact of the proposed ordinance on private, for-profit businesses in the City:

 

Private businesses will not have direct economic impact as a result of this ordinance. Business who require use of regulated trucks as outlined in the ordinance are given provision to use roads not designated as truck routes for business purposes.


3. Estimate of direct compliance costs that businesses may reasonably incur:


No compliance costs will be incurred by any private businesses.


4. Any new charge or fee imposed by the proposed ordinance, or any cost for which businesses will be financially responsible:

 

No charges or fees are to be imposed by the proposed ordinance on businesses.

 

5. Estimate of the City’s regulatory costs incurred, including estimated revenues from any new charges or fees to cover such costs:

 

Regulatory costs in the amount of $5,000 are anticipated. Costs will include installation of signage adequately providing notice of streets within the City of San Antonio that are not designated as truck routes.

 

6. Good faith estimate of the number of businesses likely to be impacted by the proposed ordinance:


7. Additional information.

 

The proposed ordinance is generally applicable to individuals and businesses. The streets designated in the ordinance as truck routes include roads already authorized for regulated truck use by FDOT and Pasco County, upon which most local businesses that receive regulated truck traffic (gas stations, retail stores, restaurants, etc.) are located. The proposed ordinance intends to reduce traffic on smaller residential streets adjacent to approved truck routes, preserving public safety and infrastructure integrity, provided that these roads were not developed with regulated truck usage in mind.

 

The ordinance includes provisions to allow regulated trucks on streets not designated as truck routes specifically for the purpose of reaching destinations, such as reaching construction sites within residential areas or delivery of goods, provided the truck routes are adhered to up to the intersection nearest the destination point.

 

The City of San Antonio discussed the proposed ordinance with the neighboring Town of St. Leo, of which ownership of Pompanic Street is split between both entities. Based on feedback from the Town of St. Leo, Pompanic Street was not included in the ordinance for consideration as a truck route.
